GENERAL CONDITIONS OF SALE
for visitors

Article 1. Scope

The General Terms and Conditions apply to all orders that you place with the ASBL LES E-SHOPS BELGES, established at 1190 Forest, Rue des Anciens Etangs 40 (Belgium), and registered with the Banque-Carrefour des enterprises under n° 0801.473.683 operating under the trade name “Les e-shops Belges”, through our platform.

Article 2. Definitions

BeneficiaryPerson holding the Gift Voucher at the time it is converted into a Purchase Code.
Purchase CodeVoucher to be used, in the form of a unique code, on the online store of the Merchant(s) selected by the Beneficiary after conversion of their Gift voucher via the platform.
Gift VoucherGift voucher marketed by Les E-shops Belges, exchangeable for one or more Purchase Code(s) to be used on the online store of one of the Members.
Merchant Any e-merchant participating in the Gift Vouchers service developed by Les E-shops Belges.
ServicesAll services, training, audits & coaching, networking events and visibility offered for sale on the platform.

Article 4. E-Shop/Online store

The Site aims to reference a growing number of Belgian e-shops and acts as an intermediary to highlight e-commerce based in Belgium. Through the Site, we also allow you to purchase Gift Vouchers to be used with one of the Merchants as a seller. These Gift Vouchers can be used either by you or by a third-party Beneficiary. Through the Site, we also allow you to purchase Services intended to help Merchants professionalize and improve their online store.

Availability

All orders for Gift Vouchers and Services are subject to availability.

Order process and conclusion of contract

To place an order on the Site, you must follow the ordering procedure.

To purchase a Gift Voucher or a Service, after registering (possibly opening a new account) you must add the desired item to your basket, select the delivery method, complete the required information fields and confirm having read these General Terms and Conditions and accept them without reservation. Otherwise, it will be impossible for you to finalize your order.

In order to validate your order, you must click on “MAKE PAYMENT” and follow the payment instructions. Before validating your order and making payment, you are asked to carefully check the order summary.

Valid payment of the order entails the conclusion of the sales contract.

Without prejudice to the foregoing, we reserve the right to refuse or cancel any order if a dispute relating to payment for a previous order is opened, or if we become aware of an order made for fraudulent.

Any order modification, even partial, after payment, is only possible with our written agreement and subject to you covering any additional costs or fees linked to this change.

Article 5. Price

The prices displayed on the Site are indicated in euros, all taxes included, excluding any delivery costs which are displayed under a separate section and added to the total.

If we are unable to fulfill your order (for example in the event of a problem linked to manufacturing or stock), all amounts paid under the contract concluded will be returned to you in full, including any possible shipping costs. delivery, to the account you used during the transaction.

Article 6. Accepted means of payment

Payment is made via the Stripe payment solution. We accept the following payment methods:
- Bank card
- Visa and Mastercard

Article 7. Payment terms

Your debit or credit card will be charged at the time of order placement.

By placing an order on the Site, you confirm that the payment information and other data provided are correct and current, and that you are authorized and have the necessary capacity to use said payment methods. We are never responsible for any harmful consequences that could result from non-compliance with this provision.

Article 8. Delivery terms

For Gift Vouchers:

When placing the order, you will choose the delivery method from the following possibilities:
- PDF to download (available directly after purchase, and also available in your history);
- standard delivery by bpost;

The Gift Voucher will be available in electronic form or sent (delivery) upon receipt of full payment of the sale price as well as any delivery costs.

If we are unable to ensure delivery of the Gift Vouchers ordered, you will be informed immediately by email. In this case, you have the right to cancel your order and obtain a refund of all amounts paid thereunder.

Postal delivery

We only ship Gift Vouchers within Belgium via bPost. The order is delivered to the delivery address provided by you during the ordering process. We are never responsible for providing an incorrect delivery address by the customer.

Your order will be considered “delivered” when you, or a third party designated by you, are in possession of the Gift Voucher(s) covered by your order.

For each order, the delivery time is indicated in the order process. If no delivery time is indicated, it will be 15 days.

The cost of postal delivery by bpost is indicated when ordering. This price includes printing costs, packaging and PRIOR shipping.

If we are unable to deliver your entire order and have to make multiple deliveries, subsequent deliveries will be included in the delivery charges paid at the time of placing the order, and will not incur any additional costs to you. your charge.

For Services

Online training will be available upon receipt of full payment of the sales price. The training will be accessible via the member area and a unique and personal connection code.

For coaching and audits, an online appointment schedule is available upon payment of the order.

For orders linked to the promotion of your e-commerce on the platform and ancillary networks, an online calendar will also be made available to allow the choice of the publication date of your article or post.< /p>

For orders linked to ticketing for fixed date events, tickets will be downloadable directly after payment and also available in your member area.

Article 9. Exchange of Gift Voucher

Validity period

Gift Vouchers are valid for a limited period of one year. An expiry date is visibly mentioned on each Gift Voucher. During the entire period of validity, they can be exchanged free of charge on the Site. Beyond the expiry date, Gift Vouchers are no longer valid.

Gift Voucher Exchange

Each Gift Voucher entitles you to an amount equivalent to its purchase value from one or more Merchant(s) selected on the Site. To redeem your Gift Voucher, you will need to go to the Site, select the Merchant(s) with whom you wish to spend all or part of your Gift Voucher. The amount of the Gift Voucher can be divided between several Merchants.

After confirming your choice, you will receive one or more Purchase Code(s) up to the selected amount to be used with the selected Merchant(s). This choice is final, it is not possible to exchange a Purchase Code for another Purchase Code.

Example: you receive a Gift Voucher for 75 euros. You choose a Purchase Code of 25 euros in store A, and a Purchase Code of 50 euros in store B.

The Gift Voucher cannot be exchanged for cash. If the amount of your purchases from the Merchant is less than the amount of the Purchase Code, the Merchant is not required to refund the difference.

Article 10. Right of withdrawal

When the consumer has agreed to conclude a contract which concerns the supply of digital content not supplied on a material medium, he has no right of withdrawal

Article 11. Force majeure

If we are prevented, in whole or in part, from executing the order due to an external, unforeseen circumstance beyond our control, this will be force majeure.

In the event of force majeure, we reserve the right to suspend execution of the order, in whole or in part, for the duration of the force majeure. In this case, you will be informed of the occurrence of force majeure as soon as possible.

Article 12. Liability

We act as an intermediary between the consumer and the Merchant members listed on the Site. Consequently, by accepting the General Terms and Conditions, you acknowledge that we are in no way responsible for any shortcomings or errors committed by Merchants, for example in the context of the use of Purchase Codes on their site.

We are exclusively liable to you for direct damage caused by our gross negligence or willful misconduct. We are not responsible for damage caused by reasons other than those mentioned above. Our liability is also limited to the sale price, for example of the Gift Voucher and delivery costs.

It is thus specified that we will never be liable for indirect, accidental, punitive, incidental or consequential damages such as, without this list being exhaustive, loss of profits or income, share of turnover , financial or economic damage, increased overheads and disruption of schedules, business interruption costs, reputational damage or loss of customers, even if such damage was reasonably foreseeable.

Concerning services linked to specific dates (date of publications, date of events, etc.), we are not held responsible in the event of changes or modifications. These changes will be notified by email as quickly as possible if they should take place and a later date set.

Article 13. Privacy

We comply with all data protection legislation in force in Belgium, including Regulation 2016/679 of the European Parliament and of the Council on the protection of individuals with regard to the Processing of personal data personal and the free circulation of this Data. Article 14. Modification of the General Terms and Conditions

We reserve the right to make any modifications to the General Conditions of Sale that we deem useful or necessary. You will always be subject to the General Terms and Conditions in force at the time you place an order on the site.

Article 15. Applicable law and jurisdiction

In the event of a dispute relating to this Site or its use, or to the supply of goods offered for sale on this Site, we invite you to seek an amicable solution with us. If, despite our efforts, an amicable solution cannot be found, Belgian law will apply and the French-speaking courts of Brussels will have jurisdiction.
